Lyle Strom
Lyle Elmer Strom was a Article III federal judge for the United States District Court for the District of Nebraska. He joined the court in 1985 after being nominated by President Ronald Reagan. Strom assumed senior status on November 2, 1995. He left office on December 1, 2023, when he died.[1]
Biography
Early life and education
A native of Nebraska, Strom graduated from Creighton University in Omaha with both his bachelor's and J.D. in 1950 and 1953.[1]
Military service
Strom served in the U.S. Navy Reserve as an ensign from 1943 to 1946.[1]
Professional career
After law school, Strom spent his entire pre-judicial legal career as a private practice attorney in Nebraska from 1953 until 1985. Strom also served on the faculty of the Creighton Law School as a part-time professor in 1958 and as a clinical professor for the Robert Spire Intern Program from 1996 to this date.[1]
Judicial career
District of Nebraska
On the recommendation of Congressman Doug Brueter, Strom was nominated by President Ronald Reagan on September 27, 1985, to a seat vacated by Albert Schatz. Strom was confirmed by the Senate on October 25, 1985, and received commission on October 28, 1985. Strom served as the chief judge of the District of Nebraska from 1987 until 1994 before assuming senior status on November 2, 1995. He left office on December 1, 2023, when he died. Strom was succeeded in this position by Joseph Bataillon. [1]
Noteworthy cases
State immune from suit in wrongful prisoner release case (2015)
Nikko Jenkins, a prisoner who requested additional mental health treatment and threatened to kill others if released, was set free by the state of Nebraska in the summer of 2013. Within a month, he had killed four people. One of those people, Andrea Kruger, was a wife and mother of three children. Her estate filed suit against the state of Nebraska for wrongful death and wrongful release of a prisoner. U.S. District Court Judge Lyle E. Strom ruled on February 9, 2015, however, that the doctrine of sovereign immunity protected the state from such suits because the act of releasing Jenkins was a discretionary function of a state employee. The case was dismissed.
Jenkins has filed a civil rights suit against the state, as well, claiming that his mental health had declined due to being kept in solitary confinement while in prison, and he was released directly from that environment back into society.
