Abstract
The relationship between German Ordoliberalism and American Neoliberalism, first analyzed by Foucalt, is of special interest today. Commentators ask if Ordoliberal theories could offer an alternative to the neoliberal developments of the last few decades, shaped by American thought. The article anayzes the main traits of Neoliberalism on the issue of the relation between law and the market. The author concludes that despite appearances to the contrary, Ordoliberalism shares several relevant background assumptions with Neoliberalism, which leads to think that Ordoliberalism cannot offer a relevant alternative to the developments that neoliberalism recently went through.
