Claims 1, 21, and 40 are amended to include the limitations of claims 10 (and 30) and to clarify that the curable compound is a condensation curable silicone rubber, Claims 13, 14, 17- 19, 24, 33, 34, 37, 38, 42, and 50 are amended aceoidingly. Claim 20 is amended to clarify that "stress" and "strain" are measured "at break," as described in paragraph [0052J of the specification. Accordingly, no new matter is added.
Item TV of Written Opinion:
The Examiner rejects the application for lack of unity because claims 1 and 21 read on a first invention and claim 40 reads on a second invention The Examiner asserts that these inventions are focused on different curable compounds and require different timing for curing. As amended, claims 1, 21, and 40 each require a condensation curable silicone rubber which, as indicated by the Examiner, is bnth novel and involves an inventive step. The condensation curable silicone rubber links this group of inventions such that they form a single general inventive concept, For purposes of this single general inventive concept the timing of curing of the condensation curable compound is immaterial. It does nut cause claim 40 to fall outside of the single concept or εupport a lack of unity rejection. Accordingly, the Applicant respectfully asserts, that this rejection should be withdrawn.
Item V of Written Opinion:
Relative to (Dl)- (D7), none of these references disclose, teach, or suggest all of the claimed features of the amended claims. The Examiner clearly indicates that both claims 10 and 30, which each focus on a condensation curable silicone rubber, are novel and include an inventive step, Amended claims 1, 21, and 40 incorporate this limitation. For this reason, the Applicant submits that amended claims 1, 21, and 40, and all claims which depend therefrom, are also novel mid involve on inventive step. item VlH of Written Opinion:
lhe Examiner rejects claims 1 for being unclear relative to the ideality of the ourable compound and timing υf the curing step, The specification and claims (prior to amendment) ieferred to embodiments wherein the curable compound is condensation curable and other embodiments wherein k i_. not However, as amended, all claims require a condensation ourable silicone robber. Moreover, the specification makes ΪL clear that the condensation curable silicone rubber can cure during or after clectrospinniπg ui can begin to cure during electrospinning and continue to cure after. Accordingly, claim 1, read rmtii independently from, and in conjunction with, the specification and other claims, is clear.
The Examiner also rejecis claim 20 for being unclear for failing to identify when "stress" and "strain" are measured. Accordingly, claim 20 is amended to clarify that "stress" ami "strain" are measured "at break." Thus, the aforementioned rejections should be withdrawn.
The Applicant submits that the claims arc all linked to funn a single general inventive concept, are clear and unambiguous, and arc both novel and involve an inventive step. Fmthcr and favorable reconsideration of the subject application is hereby requested.
