Current officeholder

The current officeholder is Brendan Beatty, who was appointed by Gov. Greg Gianforte (R) and assumed office on January 4, 2021.[2] He succeeded Gene Walborn (NP), who was appointed by Gov. Steve Bullock (D) in 2018.[3]

Title 2, Chapter 15, Part 13 of the Montana Code addresses the creation of the director of the Department of Revenue.[4]

Appointments

Per 2-15-111 of the Montana Code, the director is appointed by the governor with confirmation of the state Senate. The director serves at the pleasure of the governor and may be removed at any time.[5]

Vacancies

The governor is given to authority to fill the office of the director in 2-15-111 of the Montana Code: "If a vacancy occurs in the office of a director, the governor shall appoint a new director to serve at the pleasure of the governor."[6]

Duties

The director serves as the chief administrative officer of the Montana Department of Revenue and oversees its operations, which include the following:

  • "Administers more than 40 state taxes and fees, including income taxes, natural resource taxes, corporation taxes and miscellaneous taxes;
  • Determines values for all taxable property, including agricultural land, residential real estate, commercial real estate, forest land, business equipment, railroads and public utilities;
  • Administers agency liquor store franchise agreements, manages the state’s wholesale liquor operations, and administers laws governing the sale, taxation and licensing of alcoholic beverages; and
