Abstract

The spinnable writing instrument (100) comprises an elongated body member (104) with at least one writing tip (107). The elongated body member (104) has a first end (105) and a second end (106) with at least one writing tip (107) located at an end of the elongated body member (104). A spin apparatus (102) is also attached with the elongated body member (104). The spin apparatus (102) allows a user to rotate the elongated body member (104) in a direction relative to the spin apparatus (102).

[03] The present application is a non-provisional patent application, claiming the benefit of priority of U.S. Provisional Application No. 60/934,657, filed on June
15, 2007, entitled, "SPINZ Pens."
[04] BACKGROUND OF THE INVENTION [05] (1) Field of Invention [06] The present invention relates to a spinnable writing instrument and, more particularly, to a spinnable writing instrument which may be adapted with a variety of accessories for enhancing the rotating characteristics and aesthetics of the spinnable writing instrument.
[07] (2) Description of Related Art
[08] Contact spinning is a form of juggling in which the enthusiast performs tricks with an object that remains in close or direct contact with the enthusiast throughout the trick. Contact spinning, as it relates to writing instruments, has grown from an activity engaged by those seeking a diversion from boredom to an international phenomenon. Competitions are conducted which enjoy sponsorship from a variety of sponsors. During competitions, competitors perform a variety of tricks by carefully balancing, flipping, and twirling the writing instrument, typically a pen, often employing a combination of finger dexterity and the writing instrument's intrinsic weighting properties.
[09] Careful thought is often given to the type of writing instrument used to perform a particular trick. Practical considerations for selecting the appropriate writing instrument include the length of the instrument, the overall weight of the instrument, the distribution of weight throughout the instrument, and the overall feel of the instrument. Similarly, mastery of one trick with a particular instrument does not often translate to mastery of several other tricks with the same instrument.
[10] Coming up with a new trick and executing that trick often requires experimenting with a wide variety of writing instruments in order to determine which instrument is most suitable for executing the trick. While most commercially available writing instruments are inexpensive, purchasing a wide variety of writing instruments to match a trick with a suitable instrument can be time consuming and undesirable.
[11] An arsenal of spin instruments typically includes of a variety of pens of varying length and weight distribution. Commercially available instruments are often used to perform tricks; in rare cases these instruments have the ideal characteristics required to execute the trick. However, the enthusiast must typically take parts from one writing instrument and adapt them to fit another.
Modifying these instruments is something of an art form as experimentation with a wide breadth of knowledge of instrument parts is required to arrive at the perfect instrument for spinning.
[12] As such, mastering new tricks often requires adding another writing instrument to the enthusiast's arsenal of regularly spun writing instruments. Carrying multiple writing instruments to engage in performing multiple tricks is common amongst the more advanced enthusiasts. However, since most tricks may be practiced in a variety of locales, the burden of carrying multiple writing instruments to perform or practice multiple tricks is considered to be quite an inconvenience.
[13] Thus, a continuing need exists for a single instrument which can be modified to enhance a variety of writing instrument properties. Similarly, there is a need for a single instrument which can be modified quickly in order to change the spinning characteristics of the instrument such that one instrument can be used to engage in multiple tricks. A need also exists for a line of standardized weights which can be used to systematically modify a writing instrument to quickly achieve the enthusiasts desired instrument properties.
[14] SUMMARY OF THE INVENTION
[15] The present invention is a spinnable writing instrument with adaptable parts.
The spinnable writing instrument comprises an elongated body member with at least one writing tip, the elongated body member having a first end and a second end, wherein the at least one writing tip is located at an end of the elongated body member; and a spin apparatus attached with the elongated body member, whereby the spin apparatus allows a user to rotate the elongated body member in a direction relative to the spin apparatus.
[16] In another aspect, the spin apparatus is detachably attachable with the elongated body member.
[17] In another aspect, the present invention further comprises a weight attached with the elongated body member.
[18] In yet another aspect, the weight is detachably attached with the elongated body member such that it may be repositioned along the elongated body member to alter the writing instrument's center of gravity for executing a variety of tricks.
[19] In another aspect, the present invention further comprises a light emitting diode (LED) circuit connected with the elongated body member, the LED circuit comprising a power source, a switch, and an at least one LED.
[20] In another aspect, the switch is a centrifugal force switch such that a rotating motion of the elongated body member closes the switch of the LED circuit thereby causing the LED to turn on. [21] In another aspect, the present invention further comprises a first tip attached with the first end of the body member and a second tip attached with the second end of the body member, wherein the LED circuit is retained between the first tip and the second tip.
[22] In yet another aspect, the present invention further comprises a cap, the cap configured to form a frictional fit between the cap and the elongated body member.
[23] Finally, the present invention further comprises a method for forming the spinnable writing instrument described herein.

[47] DETAILED DESCRIPTION [48] The present invention relates to a spinnable writing instrument and, more particularly, to a spinnable writing instrument which may be adapted with a variety of accessories for enhancing the rotating characteristics and aesthetics of the spinnable writing instrument. The following description is presented to enable one of ordinary skill in the art to make and use the invention and to incorporate it in the context of particular applications. Various modifications, as well as a variety of uses, in different applications will be readily apparent to those skilled in the art, and the general principles defined herein may be applied to a wide range of embodiments. Thus, the present invention is not intended to be limited to the embodiments presented, but is to be accorded with the widest scope consistent with the principles and novel features disclosed herein. [49] In the following detailed description, numerous specific details are set forth in order to provide a more thorough understanding of the present invention. However, it will be apparent to one skilled in the art that the present invention may be practiced without necessarily being limited to these specific details. [54] The present invention relates to a spinnable writing instrument. FIG. 1 depicts a front, perspective-view of a spinnable writing instrument 100 with an attached spin apparatus 102 according to the present invention. The spinnable writing instrument 100 is comprised of an elongated body member 104 having a first end 105 and a second end 106 with at least one writing tip 107 located at an end (either the first end 105, the second end 106, or both ends). The spinnable writing instrument 100 is shown as a pen; however, as can be appreciated by one skilled in the art, the spinnable writing instrument could be formed as a pencil, marker, or any suitable instrument that is capable of marking or writing upon a surface. The spinnable writing instrument 100 may be equipped with a variety of attachments designed to improve the suitability of the spinnable writing instrument 100 for spinning in and about the user's hand, a non-limiting example of which includes the spin apparatus 102.
[55] In a desired aspect, the spin apparatus 102 is detachably attachable with the elongated body member 104 to allow the spinnable writing instrument 100 to be detached from the spin apparatus 102 when a user desires to write with the spinnable writing instrument 100. Additionally, detachably attachable spin apparatuses 102 may be easily interchanged to provide a user with several different gripping or design options. In another desired aspect, the spin apparatus 102 further comprises a mounting element 108 that is attached with the spin apparatus 102 and allows the spin apparatus 102 to be mounted in a variety of locations along the elongated body member 104. The mounting element 108 is any suitable mechanism or device for fixing the spin apparatus
102 in place, a non-limiting example of which includes a clamping mechanism as shown in FIG. 1. The mounting element 108 allows a user to execute a wide variety of tricks by simply varying the location of the spin apparatus 102 along the elongated body member 104. [56] The spin apparatus 102 may also be equipped with a swivel attachment 112 that enables the user to spin the spinnable writing instrument 100 in a plane substantially perpendicular to the swivel attachment 112. A variety of swivel attachments 1 12 may be employed, including a simple swivel connection, a retractable chord, or a quick-disconnect swivel that allows a user to quickly remove the spin apparatus 102 from the mounting element 108.
[57] In one desired aspect, as illustrated in FIG.l, the spin apparatus 102 may include a ring structure 114. The ring structure 114 is shown with an opening large enough to accommodate the width of a user's finger so that the spin apparatus
102 can be worn around the user's finger and the attached spinnable writing instrument 100 may be rotated relative to the spin apparatus 102. FIG. 2 A illustrates a front, perspective-view of a spin apparatus 102 having a ring structure 114. FIG. 2B depicts a front- view illustration of a spin apparatus 102 with a ring structure 114. FIG. 2C illustrates a side-view of a spin apparatus
102 having a ring structure 114. FIGS. 2A-2C depict a clamping type of attachment mechanism for the mounting element 108, which facilitates detachable attachment of the spin apparatus 102 with the elongated body member (not shown).
[58] FIG. 3 illustrates a front, perspective-view of a spinnable writing instrument 100 with a spin apparatus 102 having an oval structure 300. The oval structure 300 has a wide opening 302 to provide an alternate means for a user to grip the spinnable writing instrument 100 by inserting several fingers through the opening 302 of the oval structure 300. FIG. 4A illustrates a front, perspective- view of a spin apparatus 102 having an oval structure 300. FIG. 4B depicts a front- view illustration of a spin apparatus 102 with an oval structure 300. FIG. 4C illustrates a side-view of a spin apparatus 102 having an oval structure 300.
[59] FIG. 5 illustrates a front, perspective-view of a spinnable writing instrument 100 with a spin apparatus 102 having an elongated structure 500, a non-limiting example of which includes a tear-drop structure as shown. The elongated structure 500 of the spin apparatus 102 provides an additional means to hold the spinnable writing instrument 100. The elongated structure 500 may be held perpendicular to the hand, secured vertically between two fingers. Alternatively, there is the option of a user holding the elongated structure 500 between a thumb and forefinger. FIG. 6A illustrates a front, perspective-view of a spin apparatus 102 having an elongated structure 500. FIG. 6B depicts a front- view illustration of a spin apparatus 102 with an elongated structure 500. FIG. 6C illustrates a side-view of a spin apparatus 102 having an elongated structure 500.
[60] FIG. 7 illustrates a front, perspective-view of a spinnable writing instrument 100 with a spin apparatus 102 having a spherical structure 700. The spherical structure 700 of the spin apparatus 102 provides yet another means to grip the spinnable writing instrument 100. The spherical structure 700 may include at least one gripping member 702 attached with or continuous with the spherical structure 700, a non-limiting example of which includes rubber gripping bumps. As can be appreciated by one skilled in the art, the gripping member 702 may include any suitable gripping member 702 which would facilitate gripping of the spherical structure 700 in the palm or fingers of a user. FIG. 8 A illustrates a front, perspective-view of a spin apparatus 102 having a spherical structure 700. FIG. 8B depicts a front-view illustration of a spin apparatus 102 with a spherical structure 700. FIG. 8C illustrates a side-view of a spin apparatus 102 having a spherical structure 700.
[61] As illustrated in FIG. 9, the first end 105 and/or the second end 106 of the elongated body member 104 may be configured to accept a cap 900 and 902, respectively. To attach the cap 900 and 902 to the elongated body member 104, the circumference of the first end 105 and second end 106 of the elongated body member 104 may either be widened or narrowed to accept caps 900 and 902 of varying diameter. [62] The caps 900 and 902 may be configured with a variety of ornamental features such as graphics, embedded materials within the cap 900 and 902, or bevels 904. Although a cap 900 and 902 may be configured with an ornamental top 906, the ornamental top 906 may also be a functional component of the spinnable writing instrument 100. One non-limiting example is the use of a dense material to form the ornamental top 906, where the dense material increases the overall weight of the spinnable writing instrument 100. Additionally, a cap 900 and 902 may provide a functional element to the spinnable writing instrument 100 as well. For instance, the weight and length of the spinnable writing instrument
100 may be altered by the addition and removal of a cap 900 and 902.
[63] The first end 105 and second end 106 may also be coated or wrapped with a variety of materials to enhance a frictional fit with the respective cap 900 and 902. Although the first end 105 and second end 106 may be widened, the circumference of the ends 105 and 106 may also be narrowed such that the surface of the elongated body member 104 and the caps 900 and 902 form one continuous surface.
[64] The first end 105 and the second end 106 of the elongated body member 104 may also be configured with notches 907 for accepting a ring 908. The colors of the ring 908 may be varied to suit the aesthetic taste of the user. The ring 908 may also be made from a wide variety of materials. For example, the ring 908 may be made from a material that glows in the dark for spinning in the dark. Another alternative for the ring 908 may be a dense metal or composite which may differentially add mass to one end (first end 105) or another (second end 106), or both ends 105 and 106 to change the overall weight and length characteristics of the spinnable writing instrument 100. A wide variety of rings 908 may be made to fine tune the weight properties of the spinnable writing instrument 100. Each ring 908 may be configured to fit within a notch 907 of the elongated body member 104. This can be done to form one continuous surface between the rings 908 and the elongated body member 104. As can be appreciated by one skilled in the art, any of the adaptable parts for the spinnable writing instrument 100 described herein (i.e., caps 900 and 902 or rings 908) may be utilized alone or in combination to evenly weight the spinnable writing instrument 100 so that the center of gravity is approximately at the center of the spinnable writing instrument 100. Likewise, the center of gravity of the spinnable writing instrument 100 may be easily altered with the addition or removal of caps 900 and 902 and/or rings 908 from the center to any point of the spinnable writing instrument 100.
[65] A tip 910 may be added to an end 105 and 106 of the elongated body member 104. The tip 910 may be attached with an end 105 and 106 by a variety of methods. One such attachment mechanism is a frictional fit between a widened head 912 and the cap 902. The tip 910 is adapted so that it may be quickly removed and substituted with a variety of other tips 910. Each tip 910 may be configured with a light apparatus (e.g., light emitting diode (LED) 914), an internal weight (not shown), or may be made from a wide variety of lightweight or heavy tips.
[66] The elongated body member 104 of the spinnable writing instrument 100 may be equipped with a dispensing tube 916 that allows the spinnable writing instrument 100 to be used as a pen, pencil, or marker. The dispensing tube 916 may therefore be configured to retain liquid graphite, graphite, as well as a wide variety of other inks. The dispensing tube 916 may also be modified by equipping the dispensing tube 916 with a variety of small weights (not shown) to differentially weight the pen.
[67] As shown in FIG. 10, modifying the length of the spinnable writing instrument
100 may be accomplished by attaching a cap 902 to the spinnable writing instrument 100. Increasing the first end 105 and second end 106 of the elongated body member 104 allows additional rings 908 to be added to the ends 105 and 106. The rings 908 may also be retained within a notch 907 on the first end 105 of the elongated body member 104. A top shaft cap 1002 and a bottom shaft cap 1004 may also be added to allow the user to add metal balls to a cavity within the elongated body member 104, thereby changing the center of gravity of the spinnable writing instrument 100. Both the top shaft cap 1002 and the bottom shaft cap 1004 may be made with a variety of lengths to increase the overall length of the spinnable writing instrument 100 when the top shaft cap 1002 and bottom shaft cap 1004 are attached with the elongated body member 104.
[68] Another enhancement to aid the user in spinning is a weight 1006, a non- limiting example of which includes a weight ring. In a desired aspect, the weight 1006 is detachably attachable with the body member. For instance, the weight 1006 may be in the form of a ring 908 placed along the elongated body member 104. Additionally, as shown in FIG. 10, the weight 1006 may be slid up and down the circumference of an ink well 1008 which resides within and is attached with the elongated body member 104. The ink well 1008 is equipped with a pen tip 1010 and an ink cap 1012. As can be appreciated by one skilled in the art, the weight 1006 may be attached with the elongated body member 104 through any mechanism which facilitates attachment without interfering with the spinning or writing functions of the spinnable writing instrument 100. The attachment may include, but is not limited to, a free attachment that allows the weight 1006 to move freely or a mechanically locked attachment. Furthermore, the center of gravity of the spinnable writing instrument 100 can be adjusted by adding or removing any number of rings 908 to one end (first end
105) or another (second end 106), or both ends 105 and 106 of the elongated body member 104. Moreover, the length and appearance of the spinnable writing instrument 100 can also be modified by adjusting the number of rings 908 attached with the elongated body member 104. [69] The cap 902 may also consist of multiple parts. For example, the cap 902 may comprise a cap body 1014 and a cap head 1016. The cap head 1016 may be attached to the cap body 1014 by a variety of methods including a thread and screw configuration or a frictional snap fit. A small gap may remain between the cap body 1014 and cap head 1016 such that a removable clip 1018 may be added for general use but removed when performing tricks.
[70] FIG. 11 illustrates a non-limiting example of a simple LED circuit. At least one LED 914 may be integrated into a circuit 1100 that includes a power supply 1102 and a circuit switch 1104. In a non-limiting example, as the spinnable writing instrument (not shown) is rotated by a user, the rotating motion forces the circuit switch 1104 closed and allows electricity to flow from a power supply 1 102 to the LED 914. Thus, the circuit switch 1 104 is a centrifugal force switch that is closed upon rotation of the spinnable writing instrument (not shown) to cause the LED 914 to illuminate.
[71] FIG. 12 illustrates a non-limiting example of placement of the spinnable writing instrument 100 in the hand 1200 of a user. As shown, a user may hold the spinnable writing instrument 100 for spinning by inserting a finger 1202 through the spin apparatus 102. Additional non-limiting examples of holding the spinnable writing instrument 100 include securing the spin apparatus 102 between fingers or gripping the spin apparatus 102 in the palm of the hand depending on the type of spin apparatus 102.
[72] FIG. 13 illustrates an adaptable cap 1300 which may be used with the spinnable writing instrument 100. The adaptable cap 1300 comprises an outer cap member 1302, an inner cap member 1304, a cap head 1016, a removable clip 1018, and a clip adaptor 1306. The removable clip 1018 can be added to or removed from the adaptable cap 1300 to enable a user to alter the center of gravity of the spinnable writing instrument 100 when the cap is attached. The removable clip 1018 includes a clip protrusion 1308 for insertion into a cavity 1310 within the clip adaptor 1306. The removable clip 1018 may be attached with the clip adaptor 1306 by a variety of methods, non-limiting examples of which include a thread and screw configuration or a frictional snap fit. As can be appreciated by one skilled in the art, the adaptable cap 1300 may be attached with either end or both ends of the spinnable writing instrument 100.
[73] Although the present invention has been discussed and depicted in the figures as a pen, it will be readily apparent to those having ordinary skill in the art that the principles of the present invention are readily adaptable to a wide variety of writing instruments. Non-limiting examples of which include liquid-graphite pencils, graphite pencils, ink pens, and markers. Further, any instrument which lends itself to contact juggling may be used. Examples of contemplated modifications that are within the spirit of the present invention include attachments that enhance the length, weight, weight distribution, aesthetic appeal, and spectator interest in tricks performed with the modified writing instrument.

Claims

What is claimed is: 1. A spinnable writing instrument comprising: an elongated body member with at least one writing tip, the elongated body member having a first end and a second end; and a spin apparatus attached with the elongated body member, whereby the spin apparatus allows a user to rotate the elongated body member in a direction relative to the spin apparatus.
2. A spinnable writing instrument as set forth in Claim 1, wherein the spin apparatus is detachably attachable with the elongated body member.
3. A spinnable writing instrument as set forth in Claim 2, further comprising a weight attached with the elongated body member.
4. A spinnable writing instrument as set forth in Claim 3, wherein the weight is detachably attached with the elongated body member such that it may be repositioned along the elongated body member to alter the writing instrument's center of gravity for executing a variety of tricks.
5. A spinnable writing instrument as set forth in Claim 4, further comprising a light emitting diode (LED) circuit connected with the elongated body member, the LED circuit comprising a power source, a switch, and an at least one LED.
6. A spinnable writing instrument as set forth in Claim 5, wherein the switch is a centrifugal force switch such that a rotating motion of the elongated body member closes the switch of the LED circuit thereby causing the LED to turn on.
7. A spinnable writing instrument as set forth in Claim 6, further comprising a first tip attached with the first end of the body member and a second tip attached with the second end of the body member, wherein the LED circuit is retained between the first tip and the second tip.
8. A spinnable writing instrument as set forth in Claim 7, further comprising a cap, the cap configured to form a frictional fit between the cap and the elongated body member.
9. A spinnable writing instrument as set forth in Claim 1, further comprising a weight attached with the elongated body member.
10. A spinnable writing instrument as set forth in Claim 9, wherein the weight is detachably attached with the elongated body member such that it may be repositioned along the elongated body member to alter the writing instrument's center of gravity for executing a variety of tricks.
11. A spinnable writing instrument as set forth in Claim 1 , further comprising a light emitting diode (LED) circuit connected with the elongated body member, the LED circuit comprising a power source, a switch, and an at least one LED.
12. A spinnable writing instrument as set forth in Claim 11 , wherein the switch is a centrifugal force switch such that a rotating motion of the elongated body member closes the switch of the LED circuit, thereby causing the LED to turn on.
13. A spinnable writing instrument as set forth in Claim 11, further comprising a first tip attached with the first end of the body member and a second tip attached with the second end of the body member, wherein the LED circuit is retained between the first tip and the second tip.
14. A method for forming a spinnable writing instrument, comprising acts of: forming an elongated body member with at least one writing tip, the elongated body member having a first end and a second end; and forming and attaching a spin apparatus with the elongated body member, whereby the spin apparatus allows a user to rotate the elongated body member in a direction relative to the spin apparatus.
15. A method for forming a spinnable writing instrument as set forth in Claim 14, wherein the spin apparatus is detachably attachable with the elongated body member.
16. A method for forming a spinnable writing instrument as set forth in Claim 15, further comprising attaching a weight with the elongated body member.
17. A method for forming a spinnable writing instrument as set forth in Claim 16, wherein the weight is detachably attached with the elongated body member such that it may be repositioned along the elongated body member to alter the writing instrument's center of gravity for executing a variety of tricks.
18. A method for forming a spinnable writing instrument as set forth in Claim 17, further comprising forming a light emitting diode (LED) circuit and connecting the LED circuit with the elongated body member, the LED circuit comprising a power source, a switch, and an at least one LED.
19. A method for forming a spinnable writing instrument as set forth in Claim 18, wherein the switch is a centrifugal force switch such that a rotating motion of the elongated body member closes the switch of the LED circuit thereby causing the LED to turn on.
20. A method for forming a spinnable writing instrument as set forth in Claim 19, further comprising forming a first tip attached with the first end of the body member and a second tip attached with the second end of the body member, wherein the LED circuit is retained between the first tip and the second tip.
21. A method for forming a spinnable writing instrument as set forth in Claim 14, further comprising attaching a weight with the elongated body member.
22. A method for forming a spinnable writing instrument as set forth in Claim 21 , wherein the weight is detachably attached with the elongated body member such that it may be repositioned along the elongated body member to alter the writing instrument's center of gravity for executing a variety of tricks.
23. A method for forming a spinnable writing instrument as set forth in Claim 14, further comprising forming a light emitting diode (LED) circuit and connecting the
LED circuit with the elongated body member, the LED circuit comprising a power source, a switch, and an at least one LED.
24. A method for forming a spinnable writing instrument as set forth in Claim 23, wherein the switch is a centrifugal force switch such that a rotating motion of the elongated body member closes the switch of the LED circuit thereby causing the LED to turn on.
25. A method for forming a spinnable writing instrument as set forth in Claim 23, further comprising forming a first tip attached with the first end of the body member and a second tip attached with the second end of the body member, wherein the LED circuit is retained between the first tip and the second tip.
