Abstract: The liberalisation process has given rise to the creation of regulatory agencies having jurisdiction on Competition law, such as the Energy National Commission ('CNE') or the Telecommunications Market Commission ('CMT'). The Spanish regulator seems to have taken a step back in its decentralisation policy and has returned to the antitrust authorities the exclusive competence to apply antitrust law. However, the unsatisfactory drafting of regulations has not clarified the existing doubts as regards the distribution of competences between those authorities and the regulatory agencies. This article will analyse the relationship between the CMT, CNE and the antitrust authorities, as well as the regulations enacted to solve the legal uncertainty derived from the dispersion of authorities charged with the enforcement of Competition law.
