Service Agreement

Your use of the Azure service is governed by the terms and conditions of the agreement under which you obtained the services.

  • For customers who purchase or renew a subscription (including free trials) online from Microsoft, your use is governed by either the Microsoft Customer Agreement ("MCA"), or the Microsoft Online Subscription Agreement ("MOSA"). Your use is governed by the latter if the MCA is not available in your geography. Visit the MCA page for availability details.
  • For customers who purchase through another Microsoft Commercial Licensing Program, such as an Enterprise Agreement, your use is governed by the licensing agreement under which you purchased the services. You can obtain a copy of your licensing agreement by contacting your Microsoft account representative or Commercial Licensing.
  • If you do not have an Azure subscription, the Microsoft Terms of Use will govern your use of the limited Azure services which can be used without a subscription.

Product Terms

The Product Terms details the availability, use terms, and privacy/security commitments for Microsoft Products and Services, including Azure.

Offer Details

Pricing and other terms and conditions for the particular Azure offer you choose are detailed in the offer details for your subscription.

Privacy Statement

The Microsoft Privacy Statement explains the personal data Microsoft processes, how Microsoft processes it, and for what purposes. Your applicable Services Agreement or the Preview Supplemental Terms may specify lesser or different privacy measures for some Preview services.

Data Protection

The Microsoft Products and Services Data Protection Addendum (“DPA”) sets forth your and Microsoft’s obligations with respect to the processing and security of Customer Data and Personal Data in connection with Azure. The Privacy and Security Terms section of the Product Terms site further sets forth exclusions from the DPA as well as additional commitments for Core Online Services and EU Data Boundary Services. The Microsoft Trust Center provides more information on security, privacy, and compliance topics for customers of Azure and other Microsoft Online Services. The Service Trust Portal (STP) is a companion feature to the Trust Center that provides access to audit reports, GDPR documentation, compliance guides, and related documents that provide more detailed information on how Microsoft helps protect your data.

Service Level Agreements

The Service Level Agreements describe commitments around uptime and connectivity for Azure.

Preview Supplemental Terms

The Preview Supplemental Terms include additional legal terms that apply to your use of Azure features that are in beta, preview, or otherwise not yet released into general availability. These terms supplement terms and exclusions applicable to “Previews” set forth in your Service Agreement, Product Terms and DPA.

Microsoft Azure Marketplace Terms

Terms and conditions governing your use of the Microsoft Azure Marketplace are set forth in the Microsoft Azure Marketplace Terms.

Microsoft Azure Government Terms

Terms and conditions governing your use of the Microsoft Azure Government Cloud are set forth in the Microsoft Online Subscription Agreement - US Government Cloud.

Microsoft Azure operated by 21Vianet

Microsoft Azure in China is a separate service sold and operated by 21Vianet. Terms and conditions are available at https://www.azure.cn/support/legal/.
